Terms and Conditions of Use for the myPERI Portal
1. Definitions
PERI – PERI Polska sp. z o.o. with its registered office in 05-860 Płochocin, 62 Stołeczna Street, entered into the register of entrepreneurs kept by the District Court for m.s.t. Warsaw, XIV Commercial Division of the National Court Register under KRS number 0000097093, NIP 118-00-45-417, with a share capital of PLN 50,000,000.00.
Password – a string of characters which, in combination with the Login, enables the authorization of the Account in the myPERI Portal.
Login – an identifier assigned to the Administrator or the User, which enables authorization in the myPERI Portal in combination with the Password.
Client – a natural person conducting business activity, a legal person or an organizational unit without legal personality, which is granted legal capacity by law, having a framework agreement, facility agreement, sales agreement or other agreement concluded with PERI, under which PERI provides services in accordance with the subject of its business.
Administrator – a natural person authorized to conclude a contract for the provision of the myPERI Portal service on behalf of the Client, who has an Account and uses the myPERI Portal on behalf of the Client as the main user.
User – a natural person to whom the Administrator has granted access to the Account in the myPERI Portal.
Account – an account that the Customer can create in the myPERI Portal in order to use its functionalities.
Services – services that PERI provides electronically, including the functionalities of the myPERI Portal.
myPERI Portal – the website at https://portal.peri.com.pl/
2. General information
2.1. These terms and conditions are addressed to Clients, Administrators and Users who intend to use or use the Services of the myPERI Portal. They specify the type of Services, the conditions of their provision, including technical requirements, prohibitions, expectations towards Administrators, Users, as well as the conditions for concluding and terminating the contract for the provision of the myPERI Portal Service, the complaint procedure and the rights and obligations of the parties.
2.2 The myPERI Portal is operated by PERI Polska sp. z o.o. with its registered office in 05-860 Płochocin, Stołeczna 62, entered into the register of entrepreneurs maintained by the District Court for m.s.t. Warsaw, XIV Commercial Division of the National Court Register under KRS number 0000097093, NIP 118-00-45-417, with share capital in the amount of PLN 50,000,000.00, e-mail address: info@peri.com.pl
2.3 The terms and conditions of use of the myPERI Portal are available free of charge in the myPERI Portal as well as on the login page in a form that can be downloaded, saved and printed. The Controller is obliged to read the Terms and Conditions of Use of the myPERI Portal before concluding the contract for the provision of the myPERI Portal Service, commencing the use of the Service, as well as familiarizing each User with these Terms and Conditions before granting access to the myPERI Portal Account.
2.4 By creating an Account and using the myPERI Portal, the Controller reads, agrees to and agrees to comply with the terms and conditions of use of the myPERI Portal.
3. Technical requirements, registration and login details
3.1 Proper use of the Portal requires:
a) installed web browser such as: Microsoft Edge, Google Chrome, Mozilla Firefox
b) access to the Internet.
3.2 The content of the myPERI Portal may be uploaded in DWG format. DWG is a format used in certain areas of design. Files with the DWG extension are compatible with AutoCAD and BricsCAD software products.
3.3 PERI is not a provider of data transmission or telecommunications services. All costs related to the data transmission or telecommunications services required for the use of the myPERI Portal are charged to the Customer on the basis of separate agreements concluded with the providers of the aforementioned services.
3.4 The Controller and the User should use appropriate technical measures to reduce the risk of data acquisition, appropriation or modification, in particular antivirus and online identity protection programs.
3.5 In order to register an Account, the Administrator fills in the registration form on the website https://portal.peri.com.pl/rejestracja A necessary condition for submitting the registration form is prior reading of these Terms, the Privacy Policy and accepting these documents.
3.6 Sending a correctly completed registration form starts the process of verifying the Administrator's person by PERI. For this purpose, PERI contacts the customer. A positive verification allows the Administrator to be granted access to the myPERI Portal and the Account.
3.7 After positive verification referred to above, the Administrator receives a Login and a temporary Password enabling logging in to the myPERI Portal Account. The Administrator is obliged to change the Password when logging in for the first time.
3.8 The User may use the Account after the Administrator has granted access. For this purpose, the Controller creates a user account directly in the myPERI Portal and grants access to the Projects and the rights to the myPERI Portal functionalities.
3.9 The Administrator independently verifies the Users.
3.10 Sections 3.5 – 3.7 apply accordingly to the change of the Administrator.
3.11 PERI deletes, at the request of the Customer, the Administrator Account whose rights have expired.
4. Scope of services
4.1 Within the Account, the Administrator has the possibility m.in. (the calculation is for reference only):
a) generating copies of documents related to the release, return of goods ordered in PERI and invoices, i.e. documents related to the performance of the framework agreement, facility agreement or other types of agreements concluded between PERI and the Customers,
b) familiarize themselves with the current documentation of PERI systems (brochures and technical and operational documentation),
c) familiarization with technological and assembly drawings dedicated to the Customer,
d) receive notifications about changes in the myPERI Portal, including the posting of new drawings in the myPERI Portal Account and their revision,
e) access to third-party applications,
f) access to instructional videos concerning, for example, scaffolding assembly, promotional videos of products and services, videos promoting events.
4.2 The drawings referred to in subsection 4.1 letter c are created for a specific Client and relate to the building object implemented by the Client.
4.3 A new version of drawings in the myPERI Portal Account replaces the previous versions, even if they have not been deleted. Uploading drawings to the myPERI Portal does not mean that they are up to date. Peri reserves the right to delete drawings from the myPERI Portal Account without giving reasons.
4.4 Instructional videos are for preview and information purposes only. The publication of the tutorial videos in the myPERI Portal does not mean that the solutions presented are up-to-date. PERI reserves the right to delete videos from the myPERI Portal without giving reasons.
4.5 Links to websites and resources, including apps, from the myPERI Portal are provided for information purposes only and do not originate from PERI. PERI recommends that you read the terms and conditions of use of such websites, including the app, and the privacy policy carefully beforehand.
4.6 Filling in the registration form referred to in subsection 3.5 is tantamount to the Client's consent to receive notifications referred to in subsection 15. 4.1(d), including notifications related to information, technical or maintenance issues. The Administrator and the User may at any time disable notifications from the Account level in the myPERI Portal.
4.7 To the e-mail address provided in the registration form referred to in subsection 3.5 or in the course of using the Service, information may be transmitted as indicated in these Terms and Conditions as well as related to informational, technical or maintenance issues of the myPERI Portal.
4.8 The duration of the Service begins at the moment of a properly conducted registration process (points 3.5-3.8) and ends with the deletion of the Account.
4.9 The Administrator and the User have the opportunity to use the Service 24 hours a day, 7 days a week.
4.10 PERI reserves the right to:
a) extension or reduction of the scope of the Service from subsection 4.1. without giving a reason,
b) temporarily restricting access to the Service in whole or in part, e.g. for technical reasons (maintenance), increasing security, introducing changes, updates or for other reasons,
c) changes in the scope of functionalities of the myPERI Portal,
d) updating the myPERI Portal.
4.11 PERI will endeavour to inform the Controller and the User in advance, in the manner chosen by PERI, of the occurrence of the events referred to in subpara. 4.10 letters a-c. The above does not create an obligation on the part of PERI to inform the Administrator and the User about the above events.
4.12 Use of the Services by the Administrator and the User after PERI has made the changes referred to in subsection 11. 4.10 letters a, c and d shall be tantamount to the Client's consent to these changes. Failure to give consent by the Administrator or the User should take place by deleting the Account.
4.13 The Administrator and the User may at any time delete the Account without giving a reason with effect for the Client. By deleting your account, the Service will be terminated.
5. Terms of Use
5.1 The services offered to Customers in the myPERI Portal are free of charge.
5.2 The Operator and the User are obliged to use the myPERI Portal Account only in accordance with the law and the provisions of these Terms and Conditions.
5.3 It is forbidden for the Administrator and the User to provide illegal content. If PERI receives information about the unlawful nature of the storage or provision of data by the Administrator and the Users, PERI will delete the Account without prior notice.
5.4 The Administrator and the User may not use the content and materials, including the shared videos, in a manner contrary to their purpose and the purposes of the myPERI Portal.
5.5 PERI retains all rights to the information, regardless of its form, including text, graphics, audio and video material, photos, icons, designs, designs, copyrights, trademarks, trade names, logos and other materials made available on the myPERI Portal, including their appearance and function.
5.6 The Administrator and the User are obliged to protect the Password and Login against disclosure to third parties. If third parties obtain a Login or Password, the Administrator or the User is obliged to immediately inform PERI about this fact and to change this data.
5.7 The Administrator and the User are obliged to log out of the Account at the end of using the myPERI Portal.
5.8 The Controller and the User may not pass on the login or password to the myPERI Portal Account to third parties.
5.9 The Controller and the User are responsible for the consequences of using the myPERI Portal Account by third parties, including unauthorised persons.
5.10 The Administrator shall be liable for the consequences of incorrect use of the myPERI Account and Portal by the Users contrary to these Terms of Use.
5.11 The Administrator and the User are obliged not to misuse the Account and the myPERI Portal. This means, in particular, that the Controller and the User may not take actions such as investigating, exploiting, testing vulnerabilities in the myPERI Portal, the network system or violating security and authentication mechanisms. PERI may monitor or review the use of the myPERI Portal by the Controller or the User.
5.12 The Controller and the User shall refrain from any attempt to retrieve information or data without authorisation, either by themselves or through unauthorised third parties, to interfere with or enable interference with the myPERI Portal, to investigate, exploit or test the weaknesses of the Account and the myPERI Portal, or to breach security or authentication mechanisms.
5.13 PERI reserves the right to delete the Account of the Administrator or the User without giving reasons.
5.14 The content available on the myPERI Portal, including its functionalities and videos, is for preview and information purposes only. The Administrator and the User may not rely solely on this content, including the functionalities of the myPERI Portal. The same applies to the websites and resources referred to in subpara. 4.5.
5.15 Opening an Account releases PERI from the obligation to provide the Customer, in writing, with the documentation referred to in subsection 1. 4.1 letters a, b and c and is tantamount to the Client's knowledge of the content of these documents. PERI, at the request of the Client, may issue, in writing, the documents referred to in subsection 1. 4 letter c after prior payment of the fee for their issuance, in the amount specified in the PERI price list or the agreement between the Client and PERI.
5.16 All rights to the myPERI Portal, the published content as well as the image material presented in the myPERI Portal are vested exclusively with PERI or PERI is entitled to use and license them. This content may be subject to trademark rights or constitute works within the meaning of the Act of 4 July 1994 on Copyright and Related Rights (Journal of Laws of 1994 No. 24, item 83, as amended) and may be subject to protection.
5.17 PERI grants the Customer a non-exclusive, non-territorial and non-transferable, non-sublicensable license (sub-license) to use the content available in the myPERI Portal, including the drawings referred to in subsection (a) of the Forum. 4.1 lit. c, for the duration of the service contract of the myPERI Portal or the framework agreement, facility contract, sales contract or other agreement under which PERI provides services in accordance with its business activity, in the following fields of use: display and playback, printing for personal use, storage of computers and other devices and media, including RAM that belongs to the Customer, by downloading digital content and saving it to the device.
5.18 The Client is entitled to use the Services only for his own use (non-commercial license).
5.19 You are prohibited from:
a) recording, recording or other forms of copying the myPERI Portal, the content available on the myPERI Portal, or parts thereof,
b) presenting and making available the content of the myPERI Portal or parts thereof to third parties other than the Customer or its employees, employees, members of bodies, consultants, subcontractors,
c) selling, renting or using the content of the myPERI Portal or parts thereof to third parties,
d) making any changes to the content of the myPERI Portal or any other modifications. This also applies to the drawings referred to in subpara. 4.1(c),
e) Other use of the content of the myPERI Portal than for personal use.
5.20 PERI reserves the right to terminate the license with immediate effect if it becomes known or becomes reliable that it has become aware of a violation of subsection 19 of the Civil Code. 5.18 and 5.19. The Client shall not be entitled to any claims against PERI in this respect.
6. Complaints
6.1 The Client may submit complaints regarding the Service:
a) by telephone at +48 22 7217 400
b) by e-mail to the address myperi@peri.com.pl
c) in writing to the address of PERI.
6.2 In the content of the complaint, the Client should include data enabling their identification, i.e. name, surname, business name, correspondence address, if they wish to receive a response in writing. Moreover, in the complaint, the Client should also indicate the subject of the complaint (description) and the demand.
6.3 If the data or information provided in the complaint needs to be supplemented, PERI will ask the Client to supplement the complaint to the extent indicated before considering the complaint.
6.4 The complaint will be considered within 14 days from the date of its submission, with the date of delivery being decisive.
6.5 The response to the complaint will be provided in the same form as the complaint.
7. Conclusion of the Agreement
7.1 The contract for the provision of the myPERI Portal Service is concluded by sending a correctly completed registration form (including reading and accepting these Terms and Conditions and the Privacy Policy) referred to in subsection 11. 3.5 and after positive verification by PERI. The agreement is concluded without the need to draw up a separate document and is made on the terms and conditions specified in this document.
7.2 The contract for the myPERI Portal Service is concluded for an indefinite period of time.
7.3 The contract for the service of the myPERI Portal may be terminated by either Party immediately without giving reasons.
7.4 The contract for the provision of the myPERI Portal Service shall be terminated by the deletion of the Account, regardless of whether this occurs as a result of actions taken by the Controller or PERI, as well as regardless of the reasons for the deletion.
7.5 Deletion of the User Account does not result in the termination of the contract for the provision of the myPERI Portal Service.
7.6 The contract for the service of the myPERI Portal is concluded in English.
7.7 Any disputes arising from the conclusion or performance of the contract for the provision of the myPERI Portal Service shall be settled by the court with jurisdiction over the registered office of PERI.
8. Liability
8.1 PERI is not obligated to update the content and functionality of the myPERI Portal.
8.2 PERI shall not be liable for:
a) any claims of the Client related to the use of the myPERI Portal, including the correctness of the content posted therein,
b) disruption in the functioning or obstruction in access to the Account and the myPERI Portal, or individual functionalities regardless of the reason,
c) the Administrator's or User's inability to use the Service or difficulties in using it,
d) consequences of force majeure,
e) consequences of the actions of third parties, including the Administrator or the User,
f) any actions taken by the Client as a result of using the Service, including technical and assembly drawings, instructional videos, websites, resources and applications made available from the level of the myPERI Portal,
g) the consequences of providing incorrect data by the Administrator or the User in the registration form referred to in subsection 3.5.
h) content and resources, including applications located on the websites referred to in subsection 4.5,
i) damage to the customer, the Administrator, the User arising from the use of the myPERI Portal or from reliance on the content or functionalities of the myPERI Portal.
8.3 PERI shall also not be liable to third parties to whom the Administration or the User has provided access to the myPERI Account and Portal.
9. Personal data
9.1 PERI is the controller of the personal data of the Customer, the Controller and the User who are natural persons within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the Regulation).
9.2 The processing of personal data is carried out in accordance with the principles set out in the Privacy Policy.
9.3 The Controller undertakes to fulfil the information obligation towards the Users in the scope of the processing of their personal data by PERI.
10. Final provisions
10.1 PERI reserves the right to amend these Terms and Conditions without giving reasons. PERI will make every effort to ensure that changes occur in particular in the event of changes in the law, technical conditions for the provision of the Service, organizational or legal transformations of PERI. The introduction of new functionalities or the commencement of the provision of new services does not require any change to these Terms.
10.2 PERI will inform you of any change to the Terms and Conditions in the myPERI Portal or by means of a notification sent to the e-mail address indicated in the registration form referred to in subsection 10.2 of the Registration Form. 3.5. The information published/sent will be at least 14 days before the new Terms come into force.
10.3 The amended Terms and Conditions shall come into force within 14 days of their publication on the myPERI Portal.
10.4 In the event of lack of consent to the change referred to in subsection 10.1 The Controller shall terminate the service contract of the myPERI Portal by deleting the Account. Failure to delete the Account will be tantamount to consent to the change of the Terms.
10.5 PERI may amend these Terms and Conditions without a period of 14 days if the amendment is due to the need to adapt the provisions of the Terms and Conditions to the applicable law or if the change is forced by the application of additional security measures in the myPERI Portal.
10.6 Any questions, opinions and requests regarding the myPERI Account and Portal should be sent to the following e-mail address: myperi@peri.com.pl
10.7 The Customer may not transfer the rights and obligations arising from the contract for the provision of the myPERI Portal Service to a third party without the prior written consent of PERI to be null and void.
10.8 In matters not covered by these Terms, the provisions of Polish law shall apply, in particular the Act of 23 April 1964 Civil Code (Journal of Laws No. No. 16, item 93, as amended. amended), the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. No. 144, item 1204, as amended. as amended).
10.9 These terms and conditions constitute the terms and conditions referred to in Article 8 of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws No. No. 144, item 1204, as amended. as amended).
10.10 These Terms and Conditions come into effect on 16.09.2024
